Terms of Service

These Terms of Service ("Terms") are an agreement between you and KHELLO regarding khello.net and its related AI character chat features (the "Service"). By accessing the Service as a guest or account holder, you agree to these Terms.

1. Eligibility and accounts

You must be at least 16 years old to use KHELLO. If the law where you live requires parental or guardian consent, you may use the Service only after receiving that consent. You must provide accurate account information, keep your sign-in method secure, and notify us if you believe your account has been compromised.

2. AI-generated fictional service

KHELLO provides interactive fiction and entertainment through AI-generated characters. Characters are not real people and may produce inaccurate, inconsistent, unexpected, or incomplete content. Replies are not professional, medical, legal, financial, therapeutic, or emergency advice and should not be relied on as fact. Character affection, memory, and relationship stages are fictional service features, not a real-world relationship.

3. Acceptable use

You may not use or attempt to use the Service to:

• Break applicable law or violate another person's rights.
• Sexualize, exploit, groom, or otherwise harm minors or other vulnerable people.
• Impersonate a real identifiable person or organization, spread deceptive information, or violate privacy, publicity, copyright, or trademark rights.
• Threaten, harass, defame, stalk, exploit, or encourage violence or self-harm.
• Bypass safety controls, age checks, authentication, usage limits, payment controls, or technical restrictions.
• Upload malware, probe security, overload the Service, automate abusive requests, scrape, reverse engineer, resell, or redistribute protected Service content or data.

4. Your content and privacy

You retain rights you already hold in the messages you send. You grant KHELLO a limited, non-exclusive, worldwide license to host, process, reproduce, and transform those messages only as reasonably necessary to provide, secure, support, and improve the Service. Our Privacy Policy explains how personal information is handled.

5. KHELLO content and intellectual property

The Service, brand, software, character designs, artwork, prompts, and other KHELLO materials are owned by KHELLO or its licensors. These Terms give you a personal, revocable, non-transferable right to use the Service for its intended purpose. They do not transfer ownership or permit commercial reuse, model training, extraction, or resale.

6. Service availability and changes

We may add, change, suspend, or discontinue features to maintain, secure, or improve the Service. Planned material changes will be communicated when reasonably possible, but urgent maintenance, provider outages, or safety incidents may require immediate action. We do not guarantee uninterrupted or error-free availability.

7. Free replies, Rubies, and paid services

• KHELLO may provide a limited number of free replies each day.
• Rubies are digital service credits with no cash value and cannot be transferred.
• Paid chat replies currently cost the amount displayed before sending.
• Ruby packs are one-time purchases, not subscriptions.
• Checkout, payment, tax, receipts, and monetary refunds are processed by Lemon Squeezy, our merchant of record.

Prices, pack sizes, and free allowances shown at purchase or use form part of your transaction. We may change future prices or allowances, but will not retroactively reduce Rubies already credited to your account except to correct error, fraud, chargeback, or refund.

8. Failed turns and refunds

If a paid turn fails before a usable reply is committed, the Rubies reserved for that turn are returned automatically. Purchase refunds, duplicate charges, missing credits, and the effect of a monetary refund on your Ruby balance are governed by our Refund Policy and applicable law.

9. Restriction and termination

We may warn, restrict, suspend, or terminate access or reverse abusive or fraudulent transactions when reasonably necessary to enforce these Terms, protect users, or comply with law. You may stop using the Service and request account deletion at any time. Provisions that by their nature should survive termination remain in effect.

10. Disclaimers and liability

To the extent permitted by law, the Service is provided "as is" and "as available" without implied warranties. KHELLO is not liable for indirect, incidental, special, consequential, or punitive loss arising from use of the Service. Nothing in these Terms excludes liability or consumer rights that cannot lawfully be excluded.

11. Changes to these Terms

We may update these Terms as the Service or law changes. We will post the effective date and provide reasonable advance notice of material changes. If a change materially harms your rights, you may stop using the Service and request account deletion before it takes effect.

12. Governing law and contact

These Terms are governed by the laws of the Republic of Korea, without limiting any mandatory consumer protections that apply where you live. Disputes will be handled by a court with jurisdiction under applicable law. Questions may be sent to muso27723@gmail.com.
